Mercurio is a customer relationship management (CRM) application that helps you manage contacts, companies, and tasks. The service includes:

• Email integration to import and organize your business communications
• AI-powered extraction of contacts, companies, and action items from emails
• Contact and company management with customizable fields
• Task tracking and follow-up management
• Semantic search across all your data

3. Account Registration

To use Mercurio, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Be at least 18 years old or have parental consent

4. Acceptable Use

You agree not to use Mercurio to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Upload or transmit malware or malicious code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Send spam or unsolicited communications
• Process data you don't have the right to process
• Use the service for illegal purposes

5. Email Integration

When you connect your email account to Mercurio, you authorize us to:

• Access and read your emails for the purpose of extracting contact and task information
• Store extracted data (contacts, companies, tasks) in your Mercurio account
• Process email content using AI services for data extraction
• You can disconnect your email and delete extracted data at any time
• We do not send emails on your behalf without explicit action from you

6. AI Processing

Mercurio uses artificial intelligence to extract information from your emails. You understand and agree that:

• AI extraction is automated and may not be 100% accurate
• You should review extracted data for accuracy
• AI processing is performed by third-party providers (Anthropic)
• Email content is processed but not stored by AI providers
• We continuously work to improve AI accuracy

7. Intellectual Property

Mercurio and its original content, features, and functionality are owned by Elio Capella Sánchez and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of all data you upload or create in Mercurio. By using the service, you grant us a limited license to process your data solely for providing the service.

8. Payment Terms

During our beta period, Mercurio is free to use. When we introduce paid plans:

• Pricing will be clearly communicated before any charges
• You will have the option to continue with a free tier or upgrade
• Paid subscriptions will be billed monthly or annually
• Refunds will be provided according to applicable consumer protection laws

9. Limitation of Liability

To the maximum extent permitted by law, Mercurio and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

10. Warranty Disclaimer

The service is provided 'as is' and 'as available' without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, secure, or error-free.

You may terminate your account at any time by contacting us or using the account deletion feature.

We may suspend or terminate your access if you violate these terms, engage in harmful activities, or fail to pay applicable fees.

Upon termination, your right to use the service ceases immediately. We will delete your data within 30 days unless legally required to retain it.

12. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through the application at least 30 days before they take effect. Continued use after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of Spain. Any disputes shall be resolved in the courts of Madrid, Spain, without prejudice to your right to bring claims in your place of residence as a consumer.
